But the promise of innovation can also prove a trap, a situation now playing out with dire consequences for possibly tens of thousands of people who received artificial hips intended to let them remain active.

The U.S. Judicial Panel on Multidistrict Litigation announced that it would consolidate all federal cases alleging injuries from teh DePuy Pinnacle hip device in the U.S. District Court for Northern Texas. Judge James Kinkeade has been selected to oversee the consolidated cases, which includes at least 57 actions filed against DePuy Orthopaedics. Future cases filed in federal court, or removed to federal court, will be transferred to the district court in Texas.

The Food and Drug Administration has hit another Johnson & Johnson unit—medical device maker DePuy Orthopaedics—with a warning letter for selling hip and other joint products without the agency's approval.

The FDA said in the letter that the company has been selling its TruMatch Personalized Solutions System, which makes artificial knee products, and the Corail Hip System without "market clearance" and in violation of the Federal Food, Drug, and Cosmetic Act.
